Terms of Service

1. The service
502Genius (502genius.com) is a subscription market-intelligence service operated by Tidepool Technologies LLC ("we", "us"). It provides analytics on the licensed Washington State cannabis market — sales trends, leaderboards, benchmarking, distribution and pricing analysis — built from public records published by the Washington State Liquor and Cannabis Board (WSLCB). 502Genius is a data and analytics product only: we do not sell, ship, broker, or otherwise handle cannabis or any other physical product. By creating an account or using the service you agree to these terms.
2. Accounts
You must provide a valid email address and keep your credentials confidential. Accounts are for a single named user: sharing login credentials, including within an organization, is not permitted — each user needs their own account. You are responsible for activity under your account.
3. Subscriptions and billing
- Paid access is billed as a recurring monthly subscription, in advance, through our payment processor. Prices are shown before checkout.
- You may cancel at any time. Cancellation stops future renewals; your access continues through the end of the billing period already paid.
- We do not issue refunds for partial billing periods. If you believe you were billed in error, contact [email protected] and we will make it right.
- We may change subscription pricing with advance notice; changes take effect at your next renewal.
4. Acceptable use
You agree not to:
- scrape, bulk-download, or use automated tools to extract the service's content beyond the export features we provide, or circumvent rate limits or access controls;
- resell, redistribute, republish, or provide the service's analytics or exports to third parties as a competing product or data feed;
- share account credentials or paywalled content access;
- use the service to violate any law or regulation, or interfere with the service's operation or security.
Normal internal business use — including sharing insights, charts, and reasonable excerpts inside your own organization — is expected and welcome.
5. Data sources and accuracy
The market data underlying the service is sourced from WSLCB traceability records obtained through public-records requests, as reported to the state by licensees. We clean, validate, and aggregate it carefully, but we do not control the underlying reporting and cannot guarantee it is complete, current, or error-free. The service is provided for informational and business-intelligence purposes only. It is not legal, financial, tax, regulatory, or compliance advice, and it is not a substitute for the official records of the WSLCB or any other authority.
6. Intellectual property
The service — including its analytics, aggregations, derived metrics, software, and presentation — is our property and is protected by intellectual-property law. Your subscription grants you a limited, non-exclusive, non-transferable license to use it for your internal business purposes. Underlying facts drawn from the public record remain public; what you may not do is reproduce our compiled analytics or product as described in Section 4.
7. Disclaimer of warranties
The service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or that the data will be error-free.
8. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or business opportunities, arising from your use of (or inability to use) the service or your reliance on its data. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose.
9. Termination
You may stop using the service and cancel at any time. We may suspend or terminate accounts that violate these terms, with notice where practicable. Sections 5 through 8 survive termination.
10. Governing law
These terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Any dispute arising from these terms or the service will be resolved in the state or federal courts located in Washington State.
11. Changes to these terms
We may update these terms from time to time. Material changes will be reflected on this page with a revised "Last updated" date, and continued use of the service after a change takes effect constitutes acceptance.
